Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Allocatiq resource forecasting platform (“Service”) operated by Allocatiq (“we”, “our”, or “us”). By creating an account or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Allocatiq platform, you confirm that you are at least 18 years old, have the authority to enter into these Terms on behalf of your organization, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

2. The Service

Allocatiq provides a cloud-based resource forecasting and capacity planning platform for professional services organizations. Features include resource allocation, timesheet management, revenue forecasting, project management, and reporting. The specific features available to you depend on the subscription plan you have selected.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice to active subscribers.

3. Account Registration and Security

You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at support@allocatiq.com if you suspect unauthorized access to your account.

One subscription covers one organization. You may not share accounts or use the Service on behalf of multiple unrelated organizations under a single subscription.

4. Subscription Plans and Billing

Plans and Pricing

The Service is offered on a subscription basis. Current pricing plans and included features are described on our pricing page. We reserve the right to change pricing with 30 days notice to existing subscribers.

Free Trial

New accounts include a 14-day free trial. No credit card is required to start a trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service. Your data is retained for 90 days after trial expiration to allow you to return.

Payment

Paid subscriptions are billed monthly or annually in advance. Payments are processed by Stripe. You authorize us to charge your payment method on a recurring basis according to your chosen billing cycle.

Refunds

Monthly subscriptions are non-refundable for the current billing period but may be cancelled at any time, effective at the end of the paid period. Annual subscriptions that are cancelled within 14 days of renewal are eligible for a prorated refund for unused months.

Seat-Based Billing

Billing is based on the number of Manager and Admin role seats in your organization. Viewer and Resource users do not count as paid seats. See the pricing page for details.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable laws
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated scripts to scrape, extract, or otherwise collect data from the Service
  • Upload or transmit malicious code, viruses, or disruptive content
  • Resell or sublicense access to the Service without our written permission
  • Impersonate any person or organization

6. Your Data

You retain all ownership rights to the data you enter into Allocatiq (“Customer Data”). You grant us a limited, non-exclusive license to process your Customer Data solely as necessary to provide the Service.

We do not sell, share, or use your Customer Data for purposes other than providing and improving the Service. See our Privacy Policy for full details.

You are responsible for ensuring that you have the necessary rights to upload any data you enter into the Service, including personnel information for resources you add to the platform.

7. Data Security

We implement reasonable technical and organizational security measures to protect your data. However, no method of transmission or storage is 100% secure. You acknowledge this inherent risk and are responsible for implementing appropriate security practices on your end, including strong passwords and access controls.

8. Uptime and Service Levels

We target 99.5% monthly uptime for the core platform. Scheduled maintenance windows will be communicated in advance. Enterprise plan subscribers have access to a formal Service Level Agreement (SLA) describing our uptime commitments and remedies in greater detail.

9. Intellectual Property

The Allocatiq platform, including all software, design, text, and graphics, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond the limited license to use the Service as described herein.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

12. Termination

You may cancel your account at any time from the billing settings within the platform. We may suspend or terminate your account if you violate these Terms, fail to pay for your subscription, or engage in conduct that poses a security risk to the Service or other users. Upon termination, your access to the Service will cease and your data will be retained for 90 days before deletion.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which Allocatiq is incorporated, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction unless otherwise agreed in writing.

14. Changes to These Terms

We may update these Terms periodically. We will notify you of material changes by email and by posting an updated version on this page with a new effective date. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
